Terms of Service

Story of Days (“we”, “us”, “our”) is an online journaling platform. The service is accessible at storyofdays.com and any associated applications (collectively, the “Service”).

These Terms of Service (“Terms”) govern your access to and use of the Service. By registering an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

You must be at least 13 years of age to use Story of Days. By creating an account, you represent and warrant that you are 13 or older. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

You must not use the Service if you have previously had an account terminated for violating these Terms, or if you are prohibited from receiving services under applicable law.

To use most features of Story of Days, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorised access.

Each account is for a single individual. Accounts are personal and non-transferable. You may not sell, share, or transfer your account to another person.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes.

You may not sublicence, sell, resell, copy, modify, distribute, or create derivative works based on the Service or its underlying technology.

You retain all ownership rights to the content you create on Story of Days — your journal entries, stories, time capsules, notes, and any other material you submit (“Your Content”).

By submitting Your Content to the Service, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you. This licence is limited to what is necessary to run Story of Days and does not allow us to use your content for advertising, AI training, or any other purpose.

Where you choose to share content with another user (via partner connections or public entries), you grant those users the right to view that content in accordance with the visibility settings you select. You can change visibility or delete content at any time, though content that another user has already viewed cannot be unseen.

You represent and warrant that you own or have the necessary rights to Your Content, that Your Content does not infringe any third-party intellectual property rights, and that Your Content complies with these Terms.

You must not use the Service to:

• ✕Violate any applicable law, regulation, or third-party rights
• ✕Post content that is defamatory, obscene, harmful, threatening, harassing, or discriminatory
• ✕Infringe any intellectual property, privacy, or other rights of any person
• ✕Upload malware, viruses, or any code designed to interfere with the Service
• ✕Attempt to gain unauthorised access to any account, system, or network
• ✕Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service
• ✕Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• ✕Create multiple accounts to circumvent a suspension or ban
• ✕Engage in any conduct that unreasonably burdens or disrupts the Service or its infrastructure
• ✕Use the Service to send unsolicited communications (spam)

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise objectionable.

All rights, title, and interest in and to the Service — including its design, software, features, trademarks, and all content we create — are and remain the exclusive property of Story of Days. Nothing in these Terms transfers any of our intellectual property rights to you.

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our collection and use of information as described in that policy.

The Service may contain links to third-party websites or services. We have no control over those sites and are not responsible for their content, privacy practices, or terms. Accessing third-party links is at your own risk.

You may stop using the Service and delete your account at any time via Settings. Upon deletion, your data is permanently and irreversibly removed.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the safety of other users or the integrity of the Service. Where practicable, we will notify you by email.

On termination, the licence we granted you ends. Sections of these Terms that by their nature should survive termination — including Sections 5, 7, 11, 12, 13, and 15 — will continue to apply.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We may change, suspend, or discontinue any feature of the Service at any time.

Nothing in these Terms excludes, restricts, or modifies any right or guarantee you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable Australian law that cannot be excluded.

To the maximum extent permitted by law, Story of Days and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including loss of data, loss of profits, or any other intangible loss.

Where our liability cannot be excluded under the Australian Consumer Law, our liability for a failure to comply with a consumer guarantee is limited, at our option, to resupplying the affected services or paying the cost of having the services resupplied.

Nothing in these Terms limits our liability for fraud, gross negligence, personal injury caused by our negligence, or any liability that cannot be lawfully excluded under Australian law.

You agree to indemnify, defend, and hold harmless Story of Days and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another person.

We may update these Terms from time to time. If we make material changes, we will notify you by email and update the “Last updated” date at the top of this page at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you should stop using the Service and delete your account before the changes take effect.

These Terms are governed by the laws of Victoria, Australia, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts of Victoria, Australia for the resolution of any disputes arising from these Terms or your use of the Service.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Story of Days regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
